Terms of Service

Article 1 (Introduction)
Shippo Pet Album (hereinafter "the Service") is a communication service operated by the Operator (hereinafter "Operator") that allows users to create digital albums of pet photos and videos and share them with family and others. To use the Service, please agree to these Shippo Pet Album Terms of Service (hereinafter "Terms"). Users of the Service (hereinafter "Users") agree to all provisions of these Terms.
- The Operator may modify these Terms by notifying Users of the changes and their effective date through postings within the Service, in-app notifications, email, or other appropriate methods. Unless otherwise specified by the Operator, the modified Terms shall take effect from the time the User first uses the Service after the revised Terms are displayed.
- The Service may have usage conditions specified in these Terms and other rules and policies. Such other rules and policies, regardless of their titles, shall constitute part of these Terms.
- In the event of any conflict between the provisions of these Terms and other rules, the provisions of these Terms shall prevail unless otherwise specified by the Operator.
Article 2 (Definitions)
- "App" refers to the applications provided for iOS and Android to use the Service.
- "Content" refers to text, images, videos, comments, and other data that Users upload, post, or share through the Service.
- "Album Owner" refers to a User who creates a digital album and has the authority to invite and manage members.
- "Album Member" refers to a User who has been invited by an Album Owner and is permitted to view, post, and comment on the album.
Article 3 (Account Registration)
- Account registration is required to use the Service. Users shall create an account using their Apple ID, Google account, or email address after agreeing to these Terms.
- Users shall register accurate and up-to-date information and shall promptly update such information if any changes occur.
- Minors must obtain parental consent before using the Service.
- The Operator may refuse registration if a User falls under any of the following:
- Registration was not performed in accordance with the prescribed method
- The person has previously been subject to penalties for violating these Terms
- Other cases where the Operator deems it inappropriate
Article 4 (Account Management)
- Users shall endeavor to prevent unauthorized use of their account information (including but not limited to display name, email address, and password) and shall bear full responsibility for managing their accounts.
- Users may not, under any circumstances, transfer or lend their accounts to third parties.
Article 5 (User Responsibilities)
- Users shall use the Service at their own responsibility and judgment. Album Owners shall be responsible for managing the behavior of members they have invited.
- Users shall, at their own responsibility and expense, properly prepare all equipment, software, and communication means necessary to use the Service.
- Users shall take security measures appropriate to their usage environment, including prevention of computer virus infections, unauthorized access, and information leaks.
- The Operator shall not be involved in or bear any responsibility for Users' usage environments.
Article 6 (Service Description)
- The Service allows Users to create digital albums of pet photos, videos, comments, and other Content, share them with invited Users, and communicate with each other through comments, likes, and other features.
- Album Owners may invite others to the Service using invite codes, making them Album Members of their digital albums.
- Persons invited pursuant to the preceding paragraph shall, in principle, be limited to family members of the inviting User or individuals with equivalent personal acquaintance.
- A free plan and a premium plan (paid) are available, and the features and storage capacity vary depending on the plan.
Article 7 (Application License)
- The Operator grants Users a non-transferable, non-exclusive license to use the App in accordance with the conditions set forth in these Terms. However, these Terms do not grant a license to use future upgrades of the App.
- The Operator may change the features or specifications of the App without notifying Users.
- Users shall not reproduce, reprint, redistribute, or otherwise copy the App or its information without prior written consent from the Operator. Users shall not modify, alter, reverse engineer, decompile, or disassemble the App.
- The App may periodically connect to the network and perform communications, which may incur additional data charges.
- Program data and related files necessary for the display and operation of the App may be automatically changed or updated without prior notice.
Article 8 (Premium Plan)
- The Premium Plan is offered through App Store or Google Play subscriptions.
- Fees, payment methods, renewal, and cancellation conditions are governed by the respective store terms and in-app instructions.
- Subscriptions will automatically renew unless cancelled at least 24 hours before the end of the current period.
- Refunds after purchase are subject to the respective store's refund policy.
Article 9 (Service Fees)
- The Service is, in principle, provided free of charge.
- If the Operator requires payment for the use of the Service, Users will be notified in advance and their consent will be obtained.
Article 10 (Rights and Responsibilities Regarding Content)
- Rights to Content belong to the User who posted it. Users grant the Operator a license to use Content within the scope necessary for providing the Service.
- Users are responsible for their own Content and shall manage it appropriately.
- Users warrant to the Operator that their Content does not infringe on the rights of the Operator or any third party. If a User defames the Operator or a third party, violates their privacy, discloses personal information without permission, violates copyright law, or otherwise infringes on rights, the User shall resolve the matter at their own responsibility and expense.
- Users shall back up their Content at their own responsibility.
Article 11 (Rights Regarding the Service)
- Except as provided in the preceding Article, all rights (ownership, intellectual property rights, portrait rights, publicity rights) relating to the materials constituting the Service (album layouts, icons, UI design, etc.), functions, and the Service (collectively, "Materials") belong to the Operator or third parties.
- Users may use the Materials to the extent necessary for using the Service. However, the Operator does not license or transfer any rights to the Materials to Users.
Article 12 (Handling of Personal Information)
The Operator shall handle personal information appropriately in accordance with the Privacy Policy. Personal information collected by the Operator shall be limited to the scope necessary for providing, operating, developing, and improving the Service and supporting Users. The Operator shall not collect personal information beyond what is necessary without User consent.
Article 13 (Prohibited Activities)
Users shall not engage in any of the following activities when using the Service:
- Acts that infringe or may infringe upon the intellectual property rights, including copyrights and trademarks, of the Operator or third parties
- Acts that infringe or may infringe upon the property, privacy, or portrait rights of the Operator or third parties
- Acts that unfairly discriminate against, defame, or damage the reputation or credibility of the Operator or third parties
- Impersonating another person, pretending to have representative or proxy authority, or falsely claiming affiliation with other persons or organizations
- Acts that lead to or may lead to criminal activity
- Posting Content that constitutes obscenity, child pornography, or child abuse
- Using the Service for the purpose of meeting strangers
- Posting Content depicting murder, assault, corpses, or other cruel acts, or Content that would generally cause feelings of disgust
- Making digital albums publicly available to an unspecified number of people beyond the intended purpose of the Service
- Unauthorized modification or deletion of information stored on the Operator's facilities
- Sending or posting harmful computer programs such as viruses
- Placing excessive load on the Operator's or third parties' servers, or interfering with the operation of the Service's network or systems
- Unauthorized access or attempts thereof
- Using the Service for commercial purposes (except where separately authorized by the Operator)
- Providing benefits to or cooperating with antisocial forces
- Acts that violate laws, regulations, or public order and morals, or infringe on the rights of others
- Posting links for the purpose of facilitating any of the above acts while knowing they fall under the above categories
- Any other acts deemed inappropriate by the Operator
Article 14 (Advertising)
- The Operator may display advertisements within the Service.
- The Operator may provide Users with announcements of new services, advertising, administrative communications, and other information through push notifications, email, or other means. However, if a User indicates through the Operator's designated method that they do not wish to receive such information, the Operator shall cease providing such information except where necessary for the provision of the Service.
Article 15 (Changes to the Service)
- The Operator may, at its discretion and for any reason, restrict, add, discontinue, change, suspend, or terminate all or part of the features of the Service and the App at any time.
- The Operator shall not be liable for any damages incurred by Users due to changes, restrictions, discontinuation, suspension, or termination of the Service or the App, except in cases of intentional misconduct or gross negligence.
Article 16 (Data Storage)
- Service data is stored on cloud services selected by the Operator.
- The Operator makes reasonable efforts to preserve data but does not guarantee complete data preservation or recovery.
- Users are encouraged to back up their important data independently.
- The Operator shall not delete a User's account or data unless requested by the User themselves. However, this does not apply in cases of violation of these Terms or termination of the Service.
- The Operator may terminate the Service for operational reasons. In such cases, the Operator shall notify Users in advance and make reasonable efforts to provide a grace period for data download and similar activities.
Article 17 (Account Deletion)
- Users may delete their account through the settings screen within the App.
- Album Owners should be mindful of the impact on other members when deleting their account.
- Users who are not Album Owners may voluntarily leave an album.
- Upon account deletion, the User's data will be deleted. Data recovery after deletion is not possible.
- The Operator may forcibly delete a User's account and refuse the use of the Service if the User falls under any of the following:
- It becomes clear that account registration was not performed in accordance with the method prescribed in Article 3, Paragraph 1
- The User has violated these Terms
- Other cases where the Operator deems it inappropriate
Article 18 (Disclaimer)
- The Operator shall not be liable for communications or activities between Users within the Service. In the event of any trouble or dispute between Users or with third parties, the parties involved shall resolve the matter among themselves.
- The Operator shall not be liable for any damages arising from reduced display speed or system failures due to excessive access or other unforeseen factors.
- The Operator is not obligated to monitor or store Content.
- The Operator does not guarantee the operation of the Service, its fitness for a particular purpose, the accuracy or reliability of its results, and bears no warranty liability of any kind.
- The Operator may view, store, or disclose Content to third parties in the following cases. The Operator shall not be liable for any damages arising therefrom:
- When necessary to identify and resolve technical issues with the Service
- When a formal inquiry is received from a public authority such as a court or police based on applicable law
- When acts violating or potentially violating these Terms have occurred and it becomes necessary to review the Content
- When there is imminent danger to a person's life, body, or property and urgent necessity exists
- When otherwise necessary for the proper operation of the Service
- If the Operator determines that there are reasonable grounds to believe that acts violating or potentially violating these Terms have been committed, the Operator may take measures such as deleting Content or restricting usage of the relevant User without prior notice. The Operator shall not be liable for any damages arising therefrom, except in cases of intentional misconduct or gross negligence.
- If these Terms constitute a consumer contract as defined in Article 2, Paragraph 3 of the Consumer Contract Act (Act No. 61 of 2000), provisions in these Terms that completely exempt the Operator from liability for damages shall not apply. In such cases, if damages incurred by the User are based on the Operator's breach of obligation or tort, the Operator's liability shall be limited to an amount equivalent to one month's service fee paid by the User to the Operator. However, this limitation does not apply in cases of intentional misconduct or gross negligence on the part of the Operator.
- Notwithstanding the provisions of these Terms, the Operator shall not be liable for the following damages in any case:
- Damages arising from causes not attributable to the Operator
- Damages arising from special circumstances, regardless of whether the Operator could have foreseen them
- Damages arising from acts essential to providing the Service, such as server maintenance
Article 19 (Prohibition of Assignment of Rights)
Users may not transfer, assign, or otherwise dispose of any rights or obligations under these Terms to third parties, except as provided in these Terms.
Article 20 (Changes to the Terms)
- The Operator may modify these Terms as deemed necessary.
- The revised Terms shall take effect from the time they are posted within the Service or on the website.
- Users will be notified of significant changes through in-app notifications or other appropriate means.
Article 21 (Governing Law and Jurisdiction)
- These Terms shall be governed by the laws of Japan.
- In the event of any doubt or dispute between the User and the Operator regarding the Service or these Terms, the parties shall first attempt to resolve the matter in good faith through consultation. If the matter cannot be resolved, the court having jurisdiction over the Operator's principal place of business shall be the exclusive court of first instance.
Article 22 (General Provisions)
- Even if any provision of these Terms is determined to be invalid under applicable law, the remaining provisions shall remain in effect.
- Even if any provision of these Terms is invalidated or cancelled in relation to a particular User, these Terms shall remain valid in relation to other Users.
